Welcome to our April 2021 Newsletter. The new normal has been with us for over 12 months. Amongst the good news is that the pubs (outdoor seating only), hairdressers and shops have now reopened.
Also (although whilst still below pre-covid numbers) the Office for National Statistics has recently reported (“GDP monthly estimate, UK: February 2021” - release date 13 April 2021), that construction output grew in February 2021 (up 1.6% (£213 m) compared with January 2021); predominantly due to a 1.5% increase in new work and 1.9% increase in repair and maintenance.
Hopefully the green shoots of recovery will continue to start to show in 2021. However, as an industry, we still have many challenges ahead. The previous and ongoing effects of the pandemic on projects and working practices continue to be felt. This includes recent warnings from the Construction Leadership Council (“Construction Product Availability Statement” 7 April 2021) regarding continued shortages of certain building materials and products which are “likely to worsen before they improve”.
Whilst many in the construction industry continue to try to work collaboratively and innovatively, it is also unfortunately inevitable that, in these difficult trading times, there will also be disputes between parties. Covid and lockdown has certainly not, it appears, put off parties from becoming embroiled in disputes, including escalating and referring disputes to adjudication (which remains a popular means of resolving disputes in the construction industry).
It therefore remains more important than ever that companies safeguard and protect their position in their dealings with others, including both contractually and financially. Consequently, it comes as no surprise that as a practice we are continuing to see a large increase in disputes and demand for our services.
