Whilst still below pre-covid numbers, nevertheless it was pleasing to read that the Office for National Statistics have reported (release 12 March 2021), a return to growth for construction output in January 2021, driven by growth in new work activity, with output up 0.9 per cent in the month (following a 2.9% drop in December 2020). Hopefully this positive growth will continue in 2021. However as an industry we know that we still have many challenges ahead.
In these difficult trading times, as we all know, it is more important than ever that companies safeguard and protect their position in their dealings with others, including both contractually and financially. Unfortunately, however, the incidence of disputes (whilst undesirable) are inevitable as part of this process and a by-product of the current tough climate. Matthew Davies’ recent article discusses a case where things can quickly escalate into a costly dispute, which was not helped in this case by the absence of a formal written Contract.
As a practice we are continuing to see a large increase in disputes and demand for our services.
